This Privacy Policy (“Privacy Policy”) explains our information collection practices and the rights and choices that you have in relation to how we collect, use, retain, and disclose your Personal Information when you visit our top-level website at www.storeitcold.com and use our Coolbot product’s internet integration with cb.storeitcold.com (each a “Website” and collectively, our “Websites”) or use Store it Cold platforms, request Store it Cold newsletters or other communications, visit our locations or Store it Cold-hosted events, hire us to provide you products or services, or otherwise interact with us through channels where this Privacy Policy is posted (collectively, the “Services”). Terms that are capitalized are defined within this Privacy Policy.
Please note that this Privacy Policy is intended to apply where we control the collection of Personal Information and determine the purposes and means for its processing.

Your use of our Websites and Services constitutes your consent to our Personal Information collection practices described in this Privacy Policy. Our Websites may include links to other websites, plug-ins, services, and social networks operated and maintained by third parties. Clicking on those links or enabling those connections may allow those third parties to collect and share information about you. Please note that we have no control over the privacy practices of those third parties, and we encourage you to review the privacy practices of every website you visit. Additionally, though this Privacy Policy acknowledges that we may obtain information about you from third parties, including information that you may provide to, or that is collected through, a third party about you, this Privacy Policy does not apply to the collection and processing of that information by the third party. Those third parties have their own information collection practices. - Information We Collect and How We Collect It
For purposes of this Privacy Policy, Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, and may include Device, Internet and Network Information. Device, Internet, and Network Information refers to device, internet, and network activity information that we and our Service Providers may collect about your device or your online activity when you interact with our Websites or platforms. Personal Information does not include anonymous or deidentified data that is not associated with a particular individual.
We may collect one or more categories of Personal Information listed below. We will collect most of this Personal Information directly from you (or from your Coolbot product). However, we also collect Personal Information through Device, Internet and Network Activity and from other sources as described below. Information derived from Device, Internet, and Network Activity refers to device, internet, and network activity that we and our Service Partners and other business partners collect, including information about how you interact with our Services online.
We may collect the following categories of Personal Information and Device, Internet and Network Information about you in the course of business, including through your use of the Services or when you contact us, leave a review for our Coolbot product, subscribe to our communications or otherwise request information from us:
- Identifiers and Contact Information, such as your name, mailing address, telephone number, email address, and social media account information.
- Coolbot Account Information, such as account name and password hash, full name (if provided), mobile phone number (if provided to send SMS updates), account creation time, referral program one-time pop-up status, login information, device name, connection times, IP address, and information about your Coolbot’s performance such as WiFi signal strength, room temperature, sensor data, and event flags). Some of this data may overlap with other categories of information.
- Financial Information, such as payment information, including credit or debit card information (collected by our payment processors only), or check or ACH information, and federal tax ID (for tax exempt entities only).
- Professional or Employment Information, such as your employer’s name and job title, if you provide it when filling out a form on the Website.
- Commercial Information, such as records of purchasing habits from us.
- Geolocation Data, such as coarse geolocation through your ZIP code or IP address, or through physical location due to a visit to a Store it Cold location.
- Audio, Electronic, or Visual Information, such as video surveillance at our physical locations or recordings of customer service calls with your consent for support and training purposes, or customer support chat or messaging logs (collected through our service providers). Video surveillance does not include any audio recordings.
- Other Service Information, such as information necessary to provide our Services to you, including information related to your employees, customers, service providers, or other third parties.
- Inferences or preferences we learn or infer about you from other information we have collected about you.
- Other information you choose to share with us.
We may supplement the information that you provide to us with information that we receive or obtain from other sources, such as our personnel, customers, professional advisors, partners, and agents, third parties with whom we interact, and publicly available sources.
Special Categories of Information
Store it Cold does not ask you to provide, and we do not knowingly collect, any special categories of Personal Information from you, including Personal Information that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or the processing of any data related to your health or data concerning your sex life, sexual orientation, or history of criminal convictions.
Device, Internet and Network Activity Information
Personal Information derived from Device, Internet and Network Activity we collect may include:
Device Data, such as information about your computer, phone, tablet, or other device you use to access our Websites. Depending on the device used, this device data may include information such as your IP address, location, device and/or browser type, hardware model, internet service provider and/or mobile carrier, and system configuration information.
Log and Usage Data, including service-related, diagnostic, usage and performance information our servers automatically collect when you access or use our Websites and which we record in log files. Depending on how you interact with us, this log data may include information about your activity on the Websites (such as data and time of your visit to our Websites), traffic data, referring/exit pages, error information, page clicks, and other communication data and the resources you access and use on the Websites. We may also collect information about your internet connection.
Information Provided by Other Sources
We may receive Personal Information about you from our Service Providers, data analytics and internet providers, and other third-party sources and commercially available sources. We may also collect publicly available information about you.
III. How We Use Your Information
We use your Personal Information for our business purposes, including to provide and improve our Websites and Services, to respond to your inquiries and requests, to prevent fraud and other criminal activity, for marketing purposes, and for other purposes for which we may notify you. For example, we may use your Personal Information for the following and other purposes as permitted or required by law:
- Provision of our Services. We use information that you voluntarily provide to us before, during, and after we engage in a transaction or an order, such as identifiers, contact information, Coolbot account information, professional or employment information, and financial information in connection with your purchase from us and for billing and collection purposes.
- We process this information to fulfill a contract with you or where necessary for our legitimate interests in providing our Services to our customers.
- Maintenance of customer relationships: We use identifiers and contact information, financial information, Coolbot account information, professional or employment information, and other service-related information to maintain our customer relationships, including to process invoices, deliver and customize our products, update customer records, and address customer inquiries or feedback.
- We process this information to fulfill a contract with you or where necessary for our legitimate interests to improve and maintain our customer relationships and to meet our customers’ needs.
- Sending relevant marketing/informational messages and customizing your experience on our Websites. We use identification data, contact details, Coolbot account information (including participation in our referral program for Coolbot), Device, Internet, and Network Activity Information, and commercial information to communicate with you via email and social media postings to provide you with information about content or Services that may be of interest to you and to customize your experience on our Websites. This may include sharing your Personal Information with our service providers, such as our referral program provider Referral Rock.
- We process this information where necessary for our legitimate interests in offering you the best information we can about our Services and in some instances, based on your consent to receive communications from us or our partners.
- Improving our Websites and Services. We use information derived from Device, Internet, and Network Activity and Coolbot account information to improve the content, functionality, and use of our Websites, conduct internal research, and to otherwise improve our Services and develop new Services.
- We process this information where necessary for our legitimate interests in continuing to improve our Services and products and in some instances based on your consent.
- Keeping our Websites and IT systems secure. We use identification data, contact details, financial information, Coolbot account information, and Device, Internet, and Network Activity Information to ensure the security and confidentiality of our Websites, network, and your data, as well as to prevent illegal activities, including fraud, which could harm you and us.
- We process this information where necessary for our legitimate interests to protect against harm to the rights, property, and safety of Store it Cold and where necessary for our legitimate interest in protecting against harm to our customers and the public, including criminal acts or violations.
- Complying with legal requirements. We use identification data, contact details, Coolbot account information, and financial information to comply with applicable legal and regulatory requirements.
- We process this information where have a legal obligation to do so, such as when responding to legal process or an enforceable government request or retaining information to meet our record-keeping obligations.
- With your consent. As described to you at the point of collection, we may use your Personal Information for other purposes with your consent, or as otherwise required or permitted by applicable laws.
- We process this information based on your consent.
If you have consented to our use of Personal Information about you for a specific purpose, you have the right to change your mind at any time, subject to contractual and legal restrictions, and reasonable prior written notice. This will not affect any processing that has already taken place. Where we are using your Personal Information because we or another entity have a legitimate interest to do so, you have the right to object to that use; however, in some cases, this may mean that you no longer use our products and services.
In the event that we de-identify any Personal Information for further use, we commit to maintain and use the information in de-identified form and will not attempt to re-identify the information, except for the purpose of determining if our de-identification processes satisfy applicable legal requirements.

We may disclose your Personal Information to the following categories of recipients:
- Our subsidiaries and affiliates, to assist us in providing or facilitating our Services to you and to improve and maintain our Services.
- To service providers (also called data processors) used to provide or facilitate our Services. We do not sell Personal Information about you in a traditional sense, but certain of our advertising and marketing activities involve disclosing Personal Information about you or allowing third parties to collect your Personal Information for targeted advertising. Targeted advertising involves seeking to place ads to you on third parties’ digital properties based, at least in part, on Personal Information obtained from your activity on others’ digital properties. Third parties that we allow to collect Personal Information directly from you may use it for targeted advertising, including by collecting information from you via cookies, pixels, and other automated tracking tools.
We do not share any Personal Information collected as a consent for SMS texting, including telephone numbers, with any third parties except as required by law.
We do not use any Personal Information for automated decision making.
In addition, we may use and disclose deidentified or aggregated information to facilitate our business operations and for other legally permitted purposes.

Right to Access/Right to Know Information. You may be entitled to a copy of the Personal Information we hold about you and to learn details about how we use it, including how we collect and disclose your Personal Information. Your Personal Information will usually be provided to you digitally. We may require you to prove your identity before providing the requested information to protect your Personal Information.
Right to Review and Correct Information. You may have the right to request that we correct any inaccurate or incomplete Personal Information we have about you.
Right to Delete Information: You may have the right to request that we delete your Personal Information. Please note that we may not be able to delete certain information depending on legal exceptions or obligations. Please see the Data Security and Retention section below for more information about why we may retain your information.
Right to Restrict Processing. You may be entitled to ask us to (temporarily) stop using your Personal Information, for example where you think the Personal Information we hold about you may be inaccurate or where you think that we no longer need to use your Personal Information.
Right to Data Portability. You may have the right to ask that we transfer Personal Information that you have provided to us to a third party of your choice (where technically feasible). This right can only be exercised when you have provided the Personal Information to us, and when we are processing that data by automated means on the basis of your consent or in order to perform our obligations under a contract with you.
Right to Object. You may request that we stop processing your Personal Information in certain circumstances, such as when we process your Personal Information for our legitimate interests. Where your Personal Information is used for marketing purposes, you may also object to the use of your Personal Information for marketing purposes at any time. Please note you may not be able to opt-out of all communications as we may need to send you information related to our Services. For other objection requests, your request may be denied if we can demonstrate compelling legitimate grounds for the processing.
Right to Withdraw Consent. Where we process your Personal Information based on your consent, you have the right to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of processing based on your consent prior to withdrawal, nor the continued processing of your Personal Information based on any other lawful basis for processing. If your consent is required to provide the Services, then we may not be able to provide certain aspects of the Services without your consent.
Your Right to Object to Automated Decision-Making. Store it Cold does not make any decisions based solely on automated processing at this time.

Please note that some of the above rights may not always apply, as there are sometimes requirements and exemptions which may mean we need to keep processing the Personal Information or not disclose it, or other times when the rights may not apply at all.
You may also click the “Cookie Policy” link [INSERT LINK] here or in the footer of the Websites and follow the instructions on that page to exercise your right to withdraw consent to the use of your Personal Information for any targeted advertising. In order to protect your Personal Information, we may ask you to provide additional information to verify your identity for any access, deletion, or correction requests.
You also have the right to complain to us and/or the applicable supervisory authority, including the UK Information Commissioner’s Office (www.ico.org.uk). California “Shine the Light” Notice.
Under California law, California residents who have provided us their Personal Information have the right to request details about our disclosures of their information to third parties for direct marketing purposes. We do not disclose Personal Information to third parties for their direct marketing purposes.
VI. Interest-Based Advertising
Please note that this Privacy Policy does not apply to the practices of third parties on their own websites or other digital properties, including our service providers or other third parties. When you access a third party’s website through links on our website, information collected from you on those third-party websites is governed by their privacy policies. For example, we and certain third-party partners may place advertisements for our services on websites, apps, and platforms operated by others. If you would prefer not to receive certain interest-based advertising, you can opt-out of this activity at the Digital Advertising Alliance (DAA) website at optout.aboutads.info, optout.networkadvertising.org, optout.privacyrights.info, and www.aboutads.info/appchoices.

VII. We Operate in the United States/Data Transfers from EEA and UK
Store it Cold is based in and operates within the United States. Your Personal Information may be transferred within our computer networks in the United States or other countries that may not be subject to data protection laws similar to or be regarded as providing an adequate level of data protection to the jurisdiction in which information is provided to or received by us.
If we transfer Personal Information (i) from within the EEA to countries located outside the EEA that have not received an adequacy decision from the European Commission, or (ii) from the UK to countries that are not recognized as offering an adequate level of protection by the UK government, including within our offices and with our service providers, we implement adequate safeguards to appropriate protect such transfer of Personal Information, including on the terms of a valid data transfer agreement incorporating the European Commission’s or the UK Information Commissioner’s Office’s standard contractual clauses or as permitted under applicable data protection laws.

Our Services are not intended for use by any minors under the age of 18. We do not intend to collect Personal Information from anyone we know to be under the age of 13. If we learn that we have unknowingly collected or received Personal Information from an individual under the age of 13, we will make reasonable efforts to delete such information from our records.
